Do I Have a Case?

I’m often asked after the initial interview of a potential client if they have a case. Usually, it is not possible to make a definite determination based solely on an interview but if you can answer affirmatively to the below listed questions, your case may be ready for the next stage of investigation. An investigator is often one of the first people to interview a potential client in an attempt to develop specific information that lawyers need to fully evaluate a case. Many times, an investgator will ask a potential client the following list of questions:

  1. Does your case involve the loss of government funds to include county, state or federal dollars?
  2. Was the loss of these dollars the result of fraud, waste or abuse?
  3. And finally, do you have evidence of the fraud or other corroborating information that would support your case and assist your legal team?

If you can answer yes to these questions, your case may be ready for the next stage of investigation. There are many factors (both legal and practical) that must be considered by your legal team. Investigators experienced in developing and expanding on the initial information you provide is essential to the case. Detailed interviews and document review by an experienced team of investigators is just the start. The potential client must be prepared to work hard with their legal team to develop the case and identify roadblocks or issues that may arise.
